1- Introduction and Acceptance of Terms of Use

Welcome to Project NXT platform, owned by RUTD Production (Egyptian Limited Liability Company) and its commercial registration number is 170518, hereinafter referred to as “the platform” or “us”.

Project NXT is an educational and entertainment platform that seeks to discover and develop talents in the field of filmmaking, acting, software and music.

The platform provides educational content aimed at discovering, developing and guiding emerging talents under the auspices of film and music industry experts in Egypt and the Arab world, in addition to its role in providing opportunities for distinguished talents to participate in artistic and musical works through competitions that take place periodically.

 

 

The platform offers financial or in-kind prizes to exceptional talents to encourage them, but it does not dispense with academic study in film or music schools. It is considered a complementary means for developing Egyptian and Arab talents, and it also provides opportunities for emerging artistic talents to appear to the widest mass base.

The platform targets talents who seek to develop their talent and penetrate the world of art, and thus help them appear in front of the public and get an opportunity for fame.

The platform creates communication opportunities between talents and those in charge of the industry and provides them with real opportunities in the field. Among its targets are also professionals working in the technical field who are looking for real talents to give them opportunities in their work.

The platform seeks providing opportunities for communication between talents and an elite group of specialists and those in charge of the artistic industry, as well as providing them with the tools and knowledge they need to achieve, turning their passion into a realistic work through workshops - courses - competitions.

The role of the platform is limited to supporting talents in Music and Filmmaking fields, allowing opportunities for education and communication with specialists and those in charge of the artistic industry, and it does not guarantee fame to talents or provide opportunities in field as it depends on the talent of the subscriber and the platform has nothing to do with it.

Read the terms carefully because they define our relation within the framework of an agreement as well as set the terms and conditions through which you can access and use the platform as well as related websites, services, applications, products and content we provide for private use without commercial purpose.

The word “you” in the Terms and Conditions indicates that you are the user of the Services.

The Terms are a legally binding agreement for all parties, so read them carefully.

 

2- Agreement to terms

By accessing or using the Platform, you agree to enter into a binding agreement with the Project NXT and your acceptance and compliance with these Terms. Your access to Platform is subject to the Privacy Policy and Community Policy, the terms of which are available on the platform from which you are downloading mobile applications or downloads from the Platform Store and must be activated here

3-  Change in Terms

These Terms are subject to change at times, for example with the functionality of the Platform by reconciling multiple applications or services that we or our affiliates operate into one common service or application, or regarding updates on organizational changes.

We are keen to inform the users of the platform of any changes that occur through an announcement on the platform or by sending alert messages to the e-mail that the user registered upon entry, so be aware of these means to know any updates.

We keep the updating date at the top of these terms, which shows the effective date of these terms. Keeping you logged in on the platform means that you agree to the terms updates. If you reject them, you must not access them.

 

4-Your account

You must create an account to access or use the Platform.

By creating an account, you agree to provide accurate and updated information. It is important that you maintain and promptly update the provided information, in case of  inaccurate or fictitious information you will be subject to some penalties, including excluding you from receiving any prize in any competition organized on the platform, as well as excluding you from participating in any training sessions or posting any content, canceling your account and exposing you to legal question if necessary

You must keep your account password confidential and not disclose it to any third party. You are also solely responsible (to us and others) for the activities that occur on your account.

We reserve the right to disable or terminate your account at any time, including if you breach any provision of these Terms or if there is activity on your account that, in our sole discretion, could damage the Platforms, violate the rights of third parties, or violate any law or applicable policy.

If you want to stop benefiting from our services and delete your account, choose "Delete Account" through the settings in your account.

Once it is deleted, you cannot reactivate it or retrieve any content or information you have added, amounts paid, or the subscription value.

5- Access and use of service

Access to and use of the Platform is subject to the Terms and all applicable laws and regulations. You may not:

Make unauthorized copies, modify, adapt, translate, reverse engineer, decompile any portions of the Services or their content including files, tables or documents (or any part thereof), limit or Attempt to identify any source code, algorithms, methods or techniques in Platform or any derivative works thereof

distribute, license, transfer or sell, in whole or in part, any of the Platform or any derivative works thereof; Marketing, renting the Platform, or using the Platform to advertise or use it for commercial purposes.

Use the Platform without our written consent for any commercial purpose or work not authorized by it.

Communication or facilitation of any commercial advertisement, or spam services.

Interfere or attempt to interfere with the way the Platform operates, take actions to disrupt our Site or any networks connected to the Services, or bypass any measures we take to prevent or restrict your access to the Platform; Integrate the Platform or any part with any other software or product. In the event of any of these cases, we have the right to keep refusing to participate, deleting accounts, or restricting your access to the platform according to the level of violation.

 

Use automated scripts to collect information on the Platform or otherwise interact with it in a manner not intended for it;

Impersonate any person or entity, or pretend to falsely represent any person or entity, falsely assign content that you publish, transmit, distribute or provide to the platform.

or technologically harmful content; any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," or any other prohibited form; all info information about third parties, including addresses and phone numbers email addresses, personal document numbers (such as ID or passport numbers), or credit card numbers; any content that infringes or may infringe any trademark, copyright or other intellectual property right or right of publicity; any material that is defamatory of any person or that is indecent, offensive, pornographic, hateful or inflammatory; any material from

Access to and use of the Platform must comply with the Community Policy.

 

We may, at any time and without prior notice, delete or suspend your access to the Content at our discretion for any reason or no reason.

One of the reasons we do this is the existence of objectionable content, inconsistent with the terms or community policy, or any content that causes any harm to users of the platform. Our automated systems analyze content (including emails) to serve you relevant, such as personalized search results, personalized ads, and spam and malware detection. We do this when we send and receive content and when we save it.

 

2- Content and contributions:

I agree and warrant that all copyrights, database rights and trademarks in the Platform and its contents, whether audio, text, images, videos, or any other form shall be the “Content” including (sessions, workshops, articles, news and updates Challenges and Society) is owned by Project NXT and it is subject to the protection of laws and copyright agreements and that all rights be reserved.

I agree that my access to the platform is limited to personal use and not for public and commercial purposes, unless otherwise expressly indicated in this document or by Project Next in writing.

You hereby agree not to copy, publish, save, broadcast, transmit, retransmit, modify, publicly display, distribute, license, perform, publish, reproduce, copy, create derivative works from platform, modify or sell or resell, exploit, transfer or upload for any commercial purposes any parts of the Content without our written consent and this applies to any part of the Platform either through using or accessing the Platform, Project Next is not intended for personal, non-commercial, entertainment use.

 

You have the right to use the Platform, its Services and Content for personal and non-commercial purposes, and you have no right to modify the Content or remove any copyright or other proprietary notices contained in the Content and you acknowledge and agree that the Platform may contain content or proprietary functions (Platform Content) in accordance with any copyright, patent, trademark, trade secret or other law or proprietary right. Except as expressly provided by Project NXT, you agree not to modify, copy, rent, loan, sell, distribute or create derivative works based on the Platform and its  Content, in whole or in part, and as otherwise shall not apply. mention it on your User Content (as defined below) that you lawfully upload to the Platform.

 

We do not intend the comments and other content on the platform to give an advice to rely on, and therefore we do not assume responsibility or liability resulting from the reliance of any visitor to the platform on that content or any person who is notified of such materials.

We can change the content at any time, and based on the importance of the update, we may resort to suspending access to the platform or closing it indefinitely. Therefore, the content may become outdated with the passage of time, and we are not responsible for updating it.

If you breach the Terms by printing, copying, or downloading any part of the Platform, we have the right to prevent you from accessing and using the Services. Accordingly, we may return or destroy any copies of those contents.

You agree to circumvent this prohibition (eg masking your IP address or using a proxy IP address).

RUTD, the owner of Project NXT and its affiliates, owns the underlying technology and software for the Services, you agree not to copy, modify, derive from, reverse engineer, reverse compile, attempt to discover any source code, or sell, assign or license any of the Subcontract or transfer any right.

Project Next shall have all rights not expressly granted herein.

 

All NXT platform identifiers, logos and trademarks of Project NXT. The Project NXT name and logo are trademarks and service marks of Project NXT (collectively, the "Next Project Marks"). NXT.

 

Project NXT names and logos and other products, platforms and logos used and displayed on the Platform may be the trademarks of their respective owners who endorse Project NXT and nothing in these Terms may or may not be associated with Project NXT. The Platform should not be construed as implying any license or right to use any of the trademarks or license, or grant the right to use any of Project NXT's trademarks on the Platform without our prior written permission,

By posting Content or Other Materials on the Platform and with other Users or Others (collectively, User Content), you warrant that you own all rights and ownership to and to the User Content including the copyright and publicity rights contained therein, and you represent that you own all rights required to post such type of User Content. Content or other materials without any infringement of the rights of a third party.

 

You also acknowledge that you agree that any questions, comments, suggestions, ideas, notes, or other information in this regard that you share on the platform or its affiliates or partners are non-confidential and the companies and partners have the right to use them for any purpose, commercial or otherwise, without obtaining your acknowledgment or providing you with any compensation.

 

I agree that Project NXT has the right to keep the content that you shared without you having the right to ask for any monetary consideration or compensation in the event that Platform Next benefits from this content or if it is required to do so by law or in good faith and whether preservation or disclosure is necessary for the following reasons :

(a) Complying with legal process or applicable laws;

(b) The terms of the platform

  (v) Respond to allegations of alleged infringement of the rights of third parties

  (d) protect the rights, property, or personal safety of Project Next and its users.

 

You know that the technical processing of your content may include the following:

(1) transmission over various networks;

(ii) Changes necessary to comply with technical requirements for connecting networks or devices.

 

You acknowledge that you are responsible for your own posts, as submitting any contents means:

 

You warrant your ownership of this content and your right to publish it for use in all the stated purposes

•  You agree to waive any intellectual rights for this content to publish it on the platform and to use it for all the purposes stipulated above
• that your participation does not infringe any rights of others or cause them to be prohibited from using the Platform;
•  You undertake that your use of the platform is legal, that your participation does not cause harm or inconvenience to others, and that it does not contain any insulting or offensive material.

 

You acknowledge that you will not solicit any other person to provide any of the following content:

•  Material that encourages the use of  unacceptable language, insulting, hurtful, threatening, violent, or intolerant (of religion, race, gender, sexual orientation, origin, age, disability, or physical or mental condition).
• Material promoting harmful information related to criminal or illegal acts (including without limitation pornography, explosives, weapons, violence, drugs, viruses, hacking or copyright infringement).
• Putting other website addresses that contain materials that violate the intellectual property rights of other people, which constitutes a legal breach.
•  Posting phone numbers or home addresses, or harassing others
•  Impersonate the platform staff, celebrities, or any other personalities or persons.
• Posting false or misleading facts.
• Acts that disrupt or threaten the security of the platform
• Intrusive and annoying advertisements or offers, or use of the platform for commercial purposes
• Any insinuations that insult the platform, others, or our products
• Any harmful contents to platform

 

As per our evaluation, we determine the occurrence of any breach of the above-mentioned provisions when you use the platform.

If any of the occurs, the following applies:

(1) Temporary or permanent blocking of your right to use the Platform and/or content therein and depriving you of opportunities to win prizes and participate in competitions.

(2)  Sending warnings.

(3) Take legal action against them to obtain compensation for all costs we have incurred due to the breach.

(4) taking further legal action against you.

 (5) disclose necessary information to law enforcement authorities as we determine is necessary

 

We exclude our liability for actions related to the violation of the above provisions. Responses to the above are not limited and we may take any other action we deem appropriate.

Emphasizing that all users are bound by these terms, you acknowledge that you are aware that users may post material that may be considered offensive or inappropriate, and we do not take any responsibility for this happening and it does not reflect our opinions.

Third Party content and linked sites

1- Under no circumstances shall Project Next be liable for third party content in any way (including users), including but not limited to errors or omissions in any content that may result in any loss or damage of any kind caused by the use of any such content.

 

2-With Project Next not reviewing the content aheas, the platform and its affiliates may delete or any content that you submitted by publishing bases on their evaluation and it is also entitled to delete any content that violates the terms of the platform

 

You agree to bear all risks associated with your use of any content.

Project NXT respects the intellectual property rights of others and we expect you to do the same. The Project Next Terms of Service and Community Guidelines do not allow you to post, share or upload any content that infringes copyright or trademark or another person's intellectual property rights.

 

Project NXT owns many intellectual property rights, including but not limited to all copyrights, trademarks, and intellectual property rights in all materials., technology, and content available on the Platform owned and/or controlled under license by ProjectNXT, its licensors, content owners, and technology providers.

 

- RUTD and/or its subsidiaries or affiliates in the MENA region own the Project Next app and website and all related registered and/or unregistered trademarks, trade names and/or service marks (named “Marks”).

- The characters, logos, names and images that we publish on the Platform (and the content on them) are also subject to property protection as registered or unregistered trademarks, trade names and/or service marks of their respective owners. Use of the Marks is not allowed unless you get a permission from Project Next.

 

• Intellectual property is a legal right that preserves the original works of their owners (such as music, video clips) and protects the ideas or facts behind those works.

 

• We encourage everyone to share original content  they own. Material that infringes a person's intellectual property rights on the platform is prohibited and will be deleted once it is spotted on it.

 

• We may consider the use of intellectual property works in certain circumstances such as fair use for doctrine or other applicable laws, trademark reference or criticism, parody, creating a fan page, or reviewing a product or service a violation of our policies.

 

•  We do not tolerate dealing with any content that violates copyrights and consider the use of copyrighted content of others without permission to obtain approval or for an illegal reason as a violation of the policies of Project NXT.

 

• Reproduction or use of the Content is not permitted without our written consent or permission from our licensors and we have the right to discontinue your use of the Service bases on our evaluation . We consider unauthorized copying or use of our Content to be a violation of software restrictions, security requirements or Own copyright.

 

• Project NXT owns all copyrights, database rights and trademarks in the platform and its contents, whether it is audio, text, images, videos, or in any other form (content) including (lessons provided, workshops, articles, news, updates, challenges and community).

 

• The content is subject to the protection of laws and copyright agreements worldwide. You acknowledge not to copy, publish, store, broadcast, transmit, retransmit, modify, publicly display, distribute, license, perform, publish, reproduce, copy, derivative works, modify, sell, resell, exploit or download these contents for commercial  purposes without obtaining prior written consent, either by accessing  or using the platform including content and services, The content of the platform is intended for personal , non-commercial  and entertainment uses.

 

• Many countries do not consider all unauthorized uses of copyrighted content to be infringing and open the door to some exceptions to copyright infringement by using copyrighted works in some cases without permission, including fair use in the US and EU (other similar exceptions under local laws applicable in other countries).

Remove  content; Suspension or deletion of the account

• Any User Content that infringes someone else's copyrights is deleted, who may be subject to account suspension or deletion due to their multiple copyright infringement in connection with use of the Project Next site or app or other violations of our Terms of Service and Community Guidelines.
• Project NXT reserves the right to refuse access to a user who has engaged in inappropriate activities
• We also delete any content that infringes other people's trademark rights.

The occurrence of repeated violations of trademark rights regarding the use of the Project NXT website or application or related to the terms of service and community guidelines, subject to suspension or deletion of the account.

Do not post, upload, download, stream, or share:

• Content that violates or infringes another person's intellectual property rights, trademark, or other intellectual property rights.

 

• A trademark is a word, symbol, logo, design, or combination that indicates the source of a product or service and distinguishes it from other products or services.

 

• Trademark laws prohibit infringement of a trademark in connection with goods or services that could cause confusion, deception, or error as to the source.

 

•  Use of another person's trademark for legally speaking about, commenting on, criticizing, emulating or reviewing the trademark owner's products or services, or comparison purpose to other products or services is not considered as a violation.

 

It is also generally permissible to create a fan page for the brand without obtaining permission from the brand, as long as you do not represent the trademark officially and you do not violate its intellectual property

• Direct contact with the user directly helps you solve your problem quickly and effectively. You can also file a trademark infringement report.

 

• Information requested in complaints must be included in the online trademark infringement report form. Missing this information will preclude our handling of the complaint and it may be dismissed. We may provide the account holder with your email contact information, trademark owner name, and/or complaint details, in accordance with our Terms of Service and Privacy Policy.

 

•  Filing a misleading or fraudulent report will hold you liable for damages under the laws of some countries.

 

•  If you wrongly received a notice of trademark infringement, contact us directly to retract this notice and provide proof of your eligibility to use the content.

 

• You may receive a call from us if you submit a report or notice of infringement to inquire about your report or notice. And Project NXT is not a party to separate third parties, and you may not be able to delete the content or suspend the account that you reported, so you can contact the person who posted the content or owns the account to try to solve your problem faster and directly.

 

• Based on what is stipulated in the Intellectual Property Protection Law, any content that you share on your personal account on the platform is a general authorization for NXT platform to use it. In violation of it, because this will hold you fully legal responsibility

 

• If you want music or audiovisual works not to be available in a country, you must submit a request to do so, so that the platform can review it, and you must send information that supports your copyright request.

 

Once the platform verifies the information and your eligibility to request the validity of your request, Project Next will do its best to implement as a pledge to try and not to guarantee the result.

 

• In accordance with its legal obligations, Project NXT provides users and rights holders with a system for resolving copyright infringement disputes, but rights holders are also entitled to assert their rights in court.

 

• As provided by intellectual property law, users may use copyrighted works without the consent of the copyright holder for quotation, criticism, review, caricature, parody or imitation, if it complies with the fair use principle.

 

• One of the conditions for inclusion of any work within the scope of copyright protection is that it must be fair, that is, it must, where necessary: (1) not be exaggerated; (ii) supported by an adequate acknowledgment of the source of the material and (iii) not causing any harm to the legitimate interests of the right holder.

 

• The copyrighted Videos are subject to Community Guidelines. It must therefore be free of hate speech or hateful conduct or be used to offend, ridicule, humiliate, embarrass, intimidate or harm anyone.

 

 Quotation, criticism and review.

 

• Citation is typically used for copyrighted works with restricted rights or “all rights reserved for defending an opinion, or engaging in an argument. It is permitted to use citations for the purposes of criticism of a copyrighted work (for example, a critical comment on a movie) or review (reviewing book or album).

 

3- Platform security and the safety of users and minors

 

• NXT puts the security and safety of users as a priority as well as content creators, business partners, vendors, and employee data including their personal information, accounts, profiles, content, and other information about them.
• We do not allow access to the Project NXT platform including the website, application, network, infrastructure or networks by unauthorized means, or to obtain confidential and sensitive personal or commercial information.
• The account will be completely banned in the event of any attempts to harm the security and credibility of the platform and products.

 

Do not post, upload, download, stream, or share:

• Accessing the Project NXT platform in an unauthorized manner and creating false or misleading copies of the platform.

 

• Creating or posting malicious files, content, or messages that may contain viruses, or other harmful materials and programs that violate community values.

 

• Use automated scripts, automated search engines, automated access codes, software, deceptive devices, or any other method to attempt to obtain confidential information of Project NXT or its users.

 

• Exploit Project NXT accounts for fraudulent or deceptive actions by posting spam, phishing, or fraudulent text messages to commit a cybercrime or gain unauthorized access to third party content, accounts, systems, or data.

 

•  Modify, adapt, translate, reverse engineer, disassemble, disassemble, or create any derivative files, tables, or documentation of any Project Next material, or otherwise attempt to access any source code, algorithms, methods, or technologies embodied in Project NXT.

 

• Allowing others to access your account for others to carry out activities that violate our community guidelines.

We are committed to protecting the safety of minors, which is a person under the age of 18. We do not tolerate activities that exploit, harm or endanger minors.

 

• We consider any content, whether animated images or digitally modified content that causes minors to be abused, exploited, or endangered, as a violation and will be deleted as soon as it is detected.

We immediately report child sexual exploitation material and any evidence of defamation to legal authorities.

 

While we are keen on the rights of minors, this category is not allowed to enter the platform, with Project NXT monitoring an account for a person under the legal age who is immediately deleted. This category is not allowed to access the platform services or apply for competitions and challenges.

 

Users are not allowed to share content that promotes or encourages Dangerous acts and challenges that may result in serious injury or death. It is also not allowed to post content that promotes or advocates group participation in dangerous or harmful activities that violate our Community Guidelines.

 

Hazardous activities are behaviors undertaken in an unprofessional context or without the necessary skills and safety precautions to perform that result in serious injury or death to the user or public, including Dangerous acts and challenges.

Do not post, upload, stream, or share:

• Content that shows the potentially inappropriate use of dangerous tools or objects
• Content that depicts dangerous driving behavior
• Content that depicts or promotes ingesting substances that are not meant for consumption and could lead to severe harm
• Content of instructions on how to perform a dangerous activity.
• Dangerous acts, challenges or movements that could cause injury or damage to property.

 

• Based on our interest in the health of community members, we do not accept publications that promote activities that lead to suicide, self-harm, or eating disorders.

 

• We delete any content that talks about or urges suicide, or the content shows self-harmful behaviors. We also remove content that shows a suicide attempt or behavior, or also any product that encourages suicide, or provides instructions on how to commit suicide, or posts that talk about suicide as a heroic or honorable act.

 

We report to law enforcement that these acts involve a specific actual threat of real harm to a person.

 

Do not post, upload, stream, or share:

• Content that depicts, promotes, normalizes, or glorifies suicide or self-harm

Do not post, upload, stream, or share:

• Content that insults another individual, or disparages an individual based on attributes such as intellect, appearance, personality traits, or hygiene
• Content that encourages coordinated harassment
• Content that disparages victims of violent tragedies

 

Project Next is a platform that includes different elements and does not accept discrimination. It is unacceptable to publish any hateful content and we move to delete it immediately.

We ban accounts and/or users that are involved in one or more severe hate violations

 

Hate speech is content that incites attacks, violence, or dehumanizes a person or group of individuals on the basis of certain characteristics:

• Ethnicity
• National origins
• Religion
• Cate
• Serious disease
• Disability
• Immigration status

 

Defamation is a term that devalues groups or individuals based on any of the above-mentioned attributes.

The platform deletes these terms in order to protect the people of Project NXT from any forms of slander about our platform, unless these terms are used in a self-referential manner or in a way that does not diminish the value of others (in an educational context).

 

As part of our belief that trust is the foundation of our society. It is not acceptable to share any activities that disturb the integrity of our platform or the authenticity of our users. Therefore, the platform deletes any content or accounts that involve parasitic or false participation, impersonation, or misleading information that causes serious harm.

 

False or misleading interaction is any act that seeks to artificially inflate popularity. We prohibit any attempts to manipulate the platform in order to increase engagement rates.

• Do not post, upload, stream, or share:

 

• any instructions that artificially increase views, likes, followers, shares, or notes.
• Methods of buying or selling views, likes, followers, shares, or notes.
• Promote services to artificially increase traffic.
• Manage multiple fake or fraudulent accounts.
• Create malware or modify code to artificially increase views, likes, followers, shares or comments.
• The misleading or fraudulent accounts are not allowed, as soon as they are detected, we ask the user to review the account, or we may ban the account.
• We comment for accounts that are spoofing as well as fan accounts where the username appears as a fan account

• Impersonating an individual or an organization by misleadingly using the name, CV or photo of another person.

The following conditions do not apply to you if you are not a beneficiary of Project NXT.

 

• Through your personal account on the platform, you will be able to check your subscription to Project NXT services’ details
•  Your account on Project NXT is for personal use only.

 

 

Choosing a one of the Project NXT packages is an agreement to pay the annual subscription fees and fees for any other services according to the package, including the expenses of your payment method.

 

There are different payment methods that you can pick from, which are provided by Project NXT. Through your account on the platform, you can change the payment method and/or change credit card details, update your data, cancel your subscription, or change your current package.

 

 

 - Any additional costs such as Internet subscription fees specified by the companies providing the service shall be borne by the user

-  The subscription value is refunded to subscribers using bank cards only within 5 working days in the event that you wish to break the subscription and refund what you paid, noting that 15% of the value of your subscription will be deducted in exchange for the administrative fees of the platform.

 

- “Billing” refers to the fees that you paid with the payment method you chose, and it is due at the beginning of the subscription or at the end of the free trial period according to the price plans announced for each service.

You must follow the renewal timing through your personal account on the Project NXT platform to pay the fees.

 

• You will be notified of any change in the price plans or services of Project Next via (e-mail, terms and conditions, platform notices).
• Project NXT subscription applies in annual basis until you cancel.
• To avoid being billed before the annual renewal date, you must inform us that you wish not to cancel the subscription.

 

• If you cancel your subscription, you will receive the same Project Next services until the end of the billing period you have paid.
• Within the framework of applicable law, no refunds are made, and we do not issue refunds or credits for any partial membership periods or for not benefiting service of Project NXT.
• Some clients get a free bonus offered by Project Next on some occasions. If you benefit from this free trial, you will receive the terms of its use, bearing in mind that it is not allowed to combine the free trial with any other offers.

 

To receive a free trial, you must have an account on the platform and choose a way to pay the fees and give  its required data, as you will be billed at the end of the free trial period with the value of the subscription package you choose in addition to (any taxes and fees), unless you cancel the subscription before the end of the free trial.

The platform will not inform you of the end date of the free trial, and to avoid being billed, you must cancel your subscription from Project Next services before the end of the grant. You can cancel your subscription through your personal account on the Project NXT platform.

6- Promotional offers/Vouchers

Sometimes we offer special promotions or memberships , Project NXT sets eligibility conditions for obtaining these offers according to its evaluation, and the “offer” has the right to cancel and suspend the account if it is decided that you are not eligible to obtain it.

  Family members with existing or recent memberships on the Platform may not be eligible to enjoy some of the offers offered for new memberships.

The platform may use the device ID, payment method, or email address of a user account in a pre-existing or recent membership on the platform to determine whether or not you are eligible for the offer. We will disclose Offer eligibility requirements, other terms and restrictions when you register for Offer or in other available communications.

 

The offer will not be refunded or exchanged for any cash or other offers if you are eligible to benefit from the promotional offers or vouchers provided by the Project Next platform, and it is also not allowed to combine two offers at the same time.

 

Project NXT offers a host of other subscription plans or promotions directly or through our Partners ("Promotions"), including free trials, low-fee subscriptions, or unlocking access to additional or featured content offers. Promotions are accompanied by a set of different terms and conditions offered by one of our partners (Promotional Terms) or by us, and by entering a promotion or entering a promotion code you agree to be bound by these promotional terms and conditions

 

• Project NXT has the right to provide promotional offers based on our own evaluation, and we also have the right to cancel the offer and suspend your account if you are not eligible to participate in it.
•  Project NXT provides links to third party websites, advertisements or offers that are not owned or controlled by us and therefore we are not responsible for these websites, advertisements or offers.

 

• You will not be charged if you have a voucher redeemable for services that give you low-fee or free access,

 

• You will be charged as soon as the voucher period ends, and you must cancel your account after that if you do not wish to complete before the end of your voucher period.

 

 

• It is your responsibility to cancel your subscription at least 24 hours before the end of the trial period/offer/discounted price.

Competitions

 

The platform opens its doors to talents who wish to participate in competitions and challenges. You must take into account the following to participate in the competition and enjoy the prizes:

The Project NXT platform offers many competitions/challenges, some for a fee and some for free. The platform specializes in identifying and choosing competitions/challenges, their specifications and prizes on their own

Contestants may not object to the results of the competitions/challenges, whether by voting or by choosing the arbitration committee, so Project Next has the exclusive right to approve the results of the competitions/challenges.

All participants in competitions/challenges are bound by all the conditions of the competition, and in the event of a breach of one or more of the conditions, Project Next has the right to reject any of the entries.

 

Contestants have the right to participate in more than one competition/challenge at the same time, and thus get more than one prize if they win.

It is not allowed to create more than one account to participate in the same competition. If this behavior is detected, the platform will delete your account. The platform shall have the right to prevent such act from participating in any future contests.

 

Reasons for not qualifying to participate in Project Next contests/challenges

 

• Failure to meet the aforementioned age eligibility criteria (at least 18 years of age)
• If an employee of Project Next

 

The Project Next monitoring team flags your account as a fraud

 

Prizes/Rewards:

 

Project Next platform offers a set of prizes / rewards for the winners of the competitions and challenges launched by the platform.

 

Consider the following  if you win:

• Prizes cannot be exchanged for other prizes or cash.

• Prizes cannot be awarded to other people.

• The Project NXT platform reserves the right to replace the prizes without notification, and the platform is committed to compensating the winners with other prizes of the same value.

 

• There should be no difference between the data that you entered on your account when applying for the competition/challenge and the data in the event of winning a prize from Project NXT.

 

Data discrepancies will disqualify you from winning a prize.

 

 

9-Unsubscribing & Account deletion

We regret that you did not hesitate to complete the service. To cancel your membership, visit your personal account on the Project Next platform.

After canceling the membership, the platform deletes the accounts.

 

• To request deletion of your account on Project Next before the expiration date, contact us on:

Once the account is deleted, you will no longer be able to access the account's activity, preferences, and other features.

 

• If you can cancel it instead of deleting it if you plan to return again to the platform, when you return within the next year in order to restart your membership, you will find your personal files and viewing preferences saved.

 

• You should consider the following:

• Your membership will be canceled at the end of the current billing, and then the account will be permanently deleted, if your membership is active

• You have the right to cancel the deletion request from the account page at the time you want before the end of your current billing period.

• If you want to use the platform again, you will have to create a new account if you delete the old one.

 

-After deleting the account, Project Next platform retains some information for the legal purpose of preventing fraud. Examples of this information are the email address registered with the account, and an encrypted and hashed copy of the payment details.

"Retail" means that the payment instrument (or email address) may be "matched" if you enter it again, but we cannot use the information to contact you or charge the payment instrument.

 

- If you delete a payment method and keep your account, in this case we keep an encrypted and hashed copy of the payment details for the stated reasons.

 

10- Terms and requirements of App stores

 

The following supplemental terms apply when accessing the Platform through specific devices, in accordance with the provisions of the applicable law.

 

These Terms are between Project NXT platform and you; Apple/Windows/Google/Huawei is not a party to these Terms.

 

Apple Store:

 

The license you acquire under this Agreement is limited to the personal, limited, non-exclusive, non-transferable right to install the Platform on Apple Devices that Apple has authorized, owns or controls for your personal, non-commercial use, subject to the usage rules set forth in the Apple App Store Terms of Services.

 

Apple assumes no responsibility for the Platform or its content and is under no obligation to provide any maintenance or support services with respect to the Platform.

 

You have the right to notify Apple if any Platform fails to comply with any applicable warranty, you may notify Apple and Apple will pay the purchase price of the Platform to you, to the maximum extent permitted by applicable law, Apple will have no further liability with respect to the Platform.

 

Apple is not responsible for addressing any claims made by you or any other party relating to the Platform or your possession or use of the Platform, for example (a) product liability claims; (b) any claim relating to the failure of the Platform to meet any applicable legal or regulatory requirements; and (c) claims for consumer protection or similar legislation.

 

Apple is not responsible for investigating a claim of intellectual property infringement that may be filed by any third party, whether by defending it, settling it, or exonerating it.

 

You acknowledge and warrant the following

(a) you are not a resident of a country that is subject to a US government embargo or a country that has been designated by the US government as "supporting terrorism";

 (b) you are not on any US list of prohibited or excluding lists.

 

Apple and its affiliates are third party beneficiaries of these Terms and after you agree to the Terms and Conditions, Apple may enforce these Terms against you as a third-party beneficiary of this Agreement.

 

NXT EXPRESSLY certifies the adoption of multiple users of the Platform through "Family Sharing" or any similar functionality made available by Apple.

Windows Phone Store:

You agree on the flowing once you download the Platform from the Windows Phone Store operated by Microsoft Corporation or its affiliates:

 

You may download and use one copy of the Platform on up to five (5) Windows Phone devices linked to the Microsoft account that you use to access the Windows Phone Store.

The store reserves the right to apply additional terms or charge additional fees.

You acknowledge that Microsoft Corporation, your telephone manufacturer and network operator have no obligation to provide any maintenance and support services with respect to the Platform.

 

 

Amazon store:

  By installing the Platform from Amazon App Store operated by Amazon Digital Services, Inc. or its affiliates ("Amazon"), you agree to the following:

When there is a discrepancy between (a) Amazon App Store Terms of Use or such other terms that Amazon specifies as the default end user license terms for the Amazon App Store (“Amazon App Store EULA Terms”) and (b) the other terms and conditions mentioned In these Terms, the terms of the Amazon App Store End User License Agreement to be effected, regarding your usage of the Platform that you downloaded from the Amazon App Store, neither NXT nor you (or any other user) are responsible or liable for Amazon's compliance with these Terms or the EULA Terms of the Amazon App Store.

 

 

Google play:

By downloading the Platform from the Google Play Store (or a replacement thereof) run by Google or its affiliates, you expressly acknowledge and agree that: If there is a conflict between (a) the Google Play Terms of Services, the Google Play Business and Software Policies, or any other terms that Google identifies as the default end user licence terms for the Google Play Store (collectively, the "Google Play Terms"), (b) the Terms and Conditions, the Google Play Terms shall control. The Google Play Terms apply to your use of the Platform that you download from Google Play in addition to those that are stated in these Terms with regard to your use of the Platform.

 

By signing, you agree that Google is not liable for NXT's or your (or any other party's) compliance with or lack of compliance with any laws.

 

 

 

11- Dispute Resolution and Governing Laws:

a. APPLICABLE LAW AND JURISDICTION: Based on what is provided for in the supplementary terms of the specific jurisdiction, these terms in their subject matter and formation shall be governed by the laws of the Arab Republic of Egypt.

Any dispute arising as a result of these Terms or any matter related to them or with respect to the existence, validity or termination of these Terms, shall be referred to and finally resolved by arbitration administered by the Cairo International Arbitration Center (“Cairo International Arbitration Center”) in accordance with their rules in force for the time being and found in These Terms and Conditions are referred to in this Article.

The arbitration shall take place in Cairo, and the arbitral tribunal shall consist of three (3) arbitrators, and the language of arbitration shall be Arabic.

 

B. No Waiver: No failure to adhere to any provision of these Terms shall be deemed a waiver of any provision or right.

c. Security: We do not guarantee that they will be secure or free from bugs or viruses. It is your personal responsibility to set up your information technology, computer software and platform to access our services. You must install antivirus software

 

d- Severability: This provision is deleted from the Terms if any court of law, having jurisdiction in this matter, without affecting the rest of the Terms, and the remaining provisions of the Terms remain valid and enforceable.

 

Limitation of Liability: To the fullest extent permitted by applicable law, Project NXT and its affiliates, agents, directors, employees, suppliers, and licensors will not be responsible for any direct or indirect damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of the use of, or inability to use, the Service. Under no circumstances shall Project NXT be responsible for any loss, harm, or damage caused by any unauthorised access to or use of the Service, your membership account, or existed  data.

 

13- Legal Disclaimer:

You are responsible for the content that you post. As a user of the Project Next Factory, you may need to seek legal advice from professionals if you have any questions regarding copyright, or trademark law before you use such content. You may also resort to legal advice to ascertain whether or not the material you plan to report to us is suspected of being infringed.

 

There are no guarantees for the Project NXT platform, as there is no guarantee that the service will not be interrupted or that some technical malfunctions will occur.

By agreeing to these terms and conditions, you waive all extraordinary, indirect and necessary remedies against us.

These terms do not affect non-disclaimer warranties or consumer protection rights you may have under the laws of your country.

Project NXT owns the intellectual property rights, especially for all information / data / used on the website and its services, including images, designs, data, texts, signs, symbols, audio and / or audiovisual works. (video) and/or graphics exclusively or any licensor, if any

 

Project NXT exclusively owns all services - which includes software services, databases, undisclosed confidential information, documents, programs, workbooks/contents, computer codes, ideas, operating methods, and any other materials (modifications / additions, improvements, works derived or adapted from such materials / works, or any intellectual property rights of provided services), including collected or specific works or software designs, and the coordination or arrangement of the contents / workbooks

• No one has the right to assert, contest, or call into doubt the ownership of those rights by the corporation or the services and contents it offers.

 

• All trademarks, logos, and service marks displayed or utilised on platforms or websites are registered, unregistered, or otherwise owned by Project NXT or its sponsors. It has no right to contest its ownership in any way, nor do its partners, affiliates, or any other businesses with which it has contracts or service agreements or your party.

 

 

- It is not allowed to use the trademarks owned by RU TD Production, a company incorporated in the Arab Republic of Egypt with limited liability and its commercial registration number 170518 – of any product or service, in a way that could cause conflict with customers, or in a manner It detracts from the value of the Project Next platform.

 

- Without written permission from the Project NXT platform, nothing related to the services may be considered as granting, implicitly or explicitly, in connection with any license or right to use / exploit / benefit from any trademark, and this applies to the platform's licensors or suppliers or the owner of the trademark and the contractor with Project Next.

 

Any abuse of our trademarks is not allowed.

 

No one may use the work on the Project NXT platform outside the platform, nor may he use it or publish it on any other website

 

14-General guidelines:

 

At NXT, we place a high value on genuineness, diversity, and inclusiveness. We believe a comfortable environment encourages everyone to do so openly, therefore we encourage creators to celebrate what makes them unique and viewers to interact with what inspires them. We value the multicultural character of our community and make an effort to respect the diverse range of cultural norms in the locations where we conduct business. By promoting only genuine content on Project NXT, we also hope to foster a culture of genuine interaction.

 

On platform, everyone is subject to our Community Guidelines. We try to carry these rules by using a combination of technology and human management, we also encourage our community members to use the tools we provide on the NXT platform to report any content or account that they believe violates our Community Guidelines.

 

We will remove any content – including video, audio, livestream, images, comments, links, or other text – that violates our Community Guidelines. Individuals are notified of our decisions and can appeal them if they believe no violation has occurred. We will temporarily or permanently ban accounts and/or users that are involved in severe or repeated on-platform violations; we may also consider actions on other platforms and offline behavior in these decisions. Circumstances that involve any instance of a threat of real-world harm to human life that is specific, credible, and imminent may be reported to law enforcement authorities.

In the event of a threat, we inform law enforcement authorities.

Project NXT experience is for people 13 and older, and we actively remove accounts of people we suspect are under this age.

 

Our algorithms are designed with trust and safety in mind. For some content, we may reduce discoverability, including the search results redirection

 

 

Based on the emergence of new risks and behaviors, these guidelines are subject to updates in consultation with the concerned authorities, as part of our commitment to maintaining the platform as a safe space for creativity and joy.
